Data Lifeboat Creator's Contract

Huzzah! You are about to create a Data Lifeboat.

This Contract outlines your responsibilities as a Data Lifeboat Creator. If you do not agree to the terms of this Contract, the Data Lifeboat Terms of Service, and the Data Lifeboat Privacy Policy, do not create a Data Lifeboat.

Your rights as a Data Lifeboat Creator

To create your Data Lifeboat you can:

  • Select Content to include in your Data Lifeboat from your Content on Flickr.com;
  • Ask other Flickr Members for their consent to include their Content in your Data Lifeboat; and
  • Expect the Foundation to maintain the Service, provide secure access to it, and allow you to edit or delete your selected Content prior to packaging it and making your Data Lifeboat available for download.

Your Data Lifeboat can be:

  • Downloaded within 7 days before it is deleted from the Foundation’s servers; and
  • Used for personal use or the use you have stipulated in your README, unless applicable laws or licensing terms permit or require otherwise.

Your obligations as a Data Lifeboat Creator

To create a Data Lifeboat you must agree to:

  • Adhere to the Data Lifeboat Terms of Service and the Data Lifeboat Privacy Policy;
  • Specify the purpose for which you are creating a Data Lifeboat and make sure it is only used for that purpose;
  • Respect the choice of Flickr Members not to have their Content included in your Data Lifeboat;
  • Respect and maintain the intellectual property rights, data protection rights, and privacy rights arising in the Content included in the Data Lifeboat you make;
  • Securely store the Personal Data of Flickr Members included in your Data Lifeboat; and
  • Remove any Personal Data of living persons included in your Data Lifeboat upon request.

Unless you have requested and received consent from Flickr Members to do so, your Data Lifeboat cannot be:

  • Uploaded in whole or in part to other platforms, unless permitted by the licensing terms of the individual images;
  • Used, sold or transferred for any purposes beyond those authorised in this agreement;
  • Used for machine learning, AI model or system training, or biometric tracking technology (e.g., facial recognition); and
  • Stored on shared drives or servers where other people may have access to it, or in asset libraries or digital asset management systems.

The Foundation’s obligations

The Foundation has an obligation to:

  • Maintain the Service and allow you secure access to, storage, editing, and deletion of the Content you have selected to be in your Data Lifeboat prior to the Creation of the Data Lifeboat;
  • Exclude Content from your Data Lifeboat for which consent for inclusion has been explicitly denied by Flickr Members;
  • Respond to your inquiries within a reasonable timeframe, no later than 10 business days of receipt;
  • Delete your Data Lifeboat Service account if you decide to stop using the Service and respond to your request to erase any Personal Data held by the Foundation; and
  • Contact you if a Flickr Member asks for the erasure of Personal Data you have included in your Data Lifeboat(s), and the Foundation is aware that you have included this Personal Data in your Data Lifeboat(s).

Data Lifeboat Terms of Service

Acceptance of Terms

You may only use the Data Lifeboat Service (“Service”) if you accept these terms and agree to be bound by them.

It is important you understand that by using this Service, you agree to comply with all applicable laws, and the Flickr, Inc., and Flickr Foundation (“Foundation”) policies, including the Data Lifeboat Privacy Policy and Data Lifeboat Creator Contract. You should also review the Flickr, Inc., Terms & Conditions of Use, which applies to activities of Flickr Members on Flickr.com (https://www.flickr.com/help/terms).

For the protection of other Flickr Members, the Foundation, and Flickr, Inc., if you do not agree with these policies you may not use the Service.

What’s the relationship between Flickr.org and Flickr.com?

The Flickr Foundation is a separate entity, a US 501(c)(3) non-profit corporation. It enjoys the permission of Flickr to use the Flickr trademarks, and the Foundation runs its own, independent finances. We are happy to have Flickr, Inc. represented on our board – please have a look at our People page to find out more.

Description of Service

The nonprofit US 501(c)(3) Flickr Foundation has created and maintains the Data Lifeboat Service.

The Data Lifeboat Service is a tool for Flickr Members to gather slivers of Flickr content to store elsewhere. The Data Lifeboat Service compiles content from Flickr, Inc., to enable archiving on non-Flickr properties. A Data Lifeboat includes but is not limited to images and video, and their metadata (“Content”) of two kinds: (1) Technical Metadata embedded in images, such as camera type, location, date and time that the photo was taken, and (2) Social Metadata created on Flickr.com, including usernames, comments, tags, and curation such as albums and galleries.

Only people with Flickr accounts (“Flickr Members”) can make Data Lifeboats.

By using the Service, Flickr Members can compile and download Content from Flickr.com into a Data Lifeboat. The Service supports this by facilitating authenticated access to Content on Flickr.com, and managing consent from Flickr Members to their Content being included in a Data Lifeboat.

Before attempting to create a Data Lifeboat, a Flickr Member must read and agree to the Data Lifeboat Terms of Service (this document), the Data Lifeboat Privacy Policy, and the Data Lifeboat Creator Contract.

Ownership of Content in Data Lifeboats

As a Flickr Member, you decide what information you make available on Flickr.com. Be aware that any Content that you contribute to Flickr.com, including information in your comments or image descriptions, is attributed to your username. By contributing Content to Flickr.com, you retain the rights in and to your Content but grant Flickr, Inc., the Foundation, and other Flickr Members a license to use such Content under the terms of the Flickr, Inc., Terms & Conditions of Use.

Flickr Members who provide Content to Flickr, Inc., own the intellectual property and other rights in their Content. Additionally, rights to certain data or images may be owned by Third Party Rightsholders such as the people in images who hold rights in their Personal Data. Personal Data includes information related to an identified or identifiable living natural person. Personal Data can cover various types of information, such as username, email address, images of living persons, or Technical and Social Metadata.

Data Lifeboat Creators may contribute additional Content to the Service, such as commentary, questions, annotations, opinions, and assertions in the README. Data Lifeboat Creators own a copyright in the compilation of Content that together makes up the Data Lifeboat. By contributing such Content to the Service, you retain the rights in your Content but grant to the Foundation an unlimited, royalty-free, nonexclusive, irrevocable, and worldwide license to use, modify, reproduce, distribute, display, and transmit your Content submitted to the Data Lifeboat Service for the purposes of providing and maintaining the Service.

How You May Access and Use the Service

You may not use the Service in any way that: interferes with the Foundation’s operations or circumvents its security measures; is unlawful, fraudulent, or otherwise harmful; or infringes or violates the rights of the Foundation, Flickr, Inc., Flickr Members, or Third Party Rightsholders.

By logging in to the Data Lifeboat Service with your Flickr account, you are able to create a Data Lifeboat. The Data Lifeboat Creator Contract and Data Lifeboat Privacy Policy applies to your use of the Service in addition to all applicable laws.

As a Data Lifeboat Creator, you can access the interactive features provided by the Service, such as creating a working draft of a Data Lifeboat and a README, and downloading your Data Lifeboat.

Suspending or Ending Participation in the Service

If we reasonably believe that you have violated these Terms of Service, other Foundation or Flickr, Inc., policies, or the applicable laws, the Foundation may limit, suspend, terminate, or modify your access to Service or portions thereof.

Activities that would provoke such a response include but are not limited to violations of copyright or other intellectual property, privacy or data protection rights, and harassment or unlawful conduct occurring through the use of the Data Lifeboat Service. If you believe a Data Lifeboat Creator has engaged in such activity, please contact the Foundation via help@datalifeboat.org.

We may request additional information from you to facilitate our investigation and suspend your account while the investigation is pending. We will notify you about any pending investigation, our evidence of your misconduct and our decision as to its consequences via the email that you provide for communications. You will be given an opportunity to contest any findings made by us by responding to our email within the prescribed, reasonable timeframe.

If you are banned or have your account revoked at any time, you may not register for the Service using another account. If you believe your account was terminated in error, you may appeal by contacting the Foundation via help@datalifeboat.org.

The Foundation is under no obligation to provide compensation for any losses that may occur due to your failure to comply with these Terms of Service, to facilitate our investigation, or due to violations of rights held by Third Parties, the improper or illegal use of the Service, or offensive conduct.

You may end your legal relationship with the Foundation at any time by contacting us via help@datalifeboat.org to let us know that you intend to discontinue your use of the Service and to make a formal request for the deletion of your data held by the Foundation. Ending your legal relationship with the Foundation will not affect your status as a Flickr Member with Flickr, Inc. However, a termination of your relationship with Flickr, Inc., leads to an automatic termination of your relationship with the Foundation.

Continuity and Security of Service

The Foundation does not guarantee uninterrupted access to the Data Lifeboat Service or Content. The Service is reliant on Flickr.com and Content contributed to Flickr.com being online and available, as well as your Flickr.com account being active. You access and use the Service and Content at your own risk. Best efforts will be made by the Foundation to assure continuity and security of the Service and Content.

Content Moderation

The Foundation does not monitor, moderate, or remove Flickr Member Content, including the Content of Data Lifeboats. Therefore, the Foundation may not be held responsible for the activities of Flickr Members, including Data Lifeboat Creators.

If you observe any improper conduct or Content used in the Service, you should contact Flickr, Inc., via the channels outlined in the Flickr Terms & Conditions of Use.

Limitation of Liability

The Foundation assumes no liability for the accuracy or suitability of any Content or information accessed through the Service, whether provided by the Foundation, Flickr Members, or Flickr, Inc. The Foundation is not responsible or liable for any damages or losses you or others incur based on your access and use of the Service, beyond any legal finding of fault or negligence.

To the fullest extent permitted by law, the Foundation shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service and Content, or your violation of the Foundation or Flickr, Inc., policies or any applicable laws.

Applicable Law and Jurisdiction

For Flickr Members living in the European Union, European Free Trade Association (EFTA) States, and the United Kingdom, EU, EFTA or UK rules respectively will apply to determine the applicable law and jurisdiction governing disputes arising under this Service.

Outside these areas, disputes arising under this Service shall be governed by Federal law or the applicable laws of the State of Delaware in the United States, without regard to its conflict of laws principles. Any case, controversy, suit, action, or proceeding arising out of, in connection with, or related to the Service shall be brought in the appropriate Federal or State court located in the State of Delaware.

Changes to Terms

The Foundation may modify or update these policies to ensure they comply with legal requirements or when the modification of our Service is required. The most current version of the Terms of Service will always be available at Terms of Service. Data Lifeboat Creators will be notified at least thirty (30) days in advance via email about forthcoming changes. By continuing to access or use the Service following the modifications or updates, Data Lifeboat Creators agree to be bound by the revised Terms of Service.

The Data Lifeboat Service is offered by the Flickr Foundation, 548 Market St, PMB 87808, San Francisco, California 94104-5401, USA. You can contact us by post at our address, emailing us at hello@flickr.org, or using this online contact form. The Foundation will respond within 10 working days of receipt of the communication. We will require proof of identity to facilitate your request.

Because Content is sourced by the Service from Flickr.com, the Foundation may respond that your request should be directed to Flickr, Inc., for resolution.

For Flickr Members based in the United States, the Digital Millennium Copyright Act of 1998 (“DMCA”) and other applicable laws, Flickr, Inc., maintains a policy on account termination and content moderation related to rights infringements. If you are a copyright owner or are authorised to act on behalf of one, please report alleged copyright infringements taking place on or through the Service by completing the following DMCA Notice of Alleged Infringement and delivering it to Flickr, Inc.,’s Designated Copyright Agent.

DMCA Notice of Alleged Infringement (“Notice”):

  • Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by this Notice you may provide a representative list of the copyrighted works that you claim have been infringed
  • Identify the material you claim is infringing (or to be subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Flickr, Inc., to locate the material, including at a minimum, if applicable, the URL of the link shown on the Services where such material may be found
  • Provide your mailing address, telephone number, and, if available, email address
  • Include both of the following statements in the body of the Notice: (i) “I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as fair use)”; and (ii) “I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”
  • Provide your full legal name and your electronic or physical signature. Deliver this Notice, with all items completed, to Flickr’s Designated Copyright Agent.

Data Lifeboat Privacy Policy

Overview

This Data Lifeboat Privacy Policy focuses on the privacy interests of Data Lifeboat Creators and Flickr Members whose Content is selected for inclusion in a Data Lifeboat. This Privacy Policy describes the Foundation’s obligations for Personal Data that is collected with the Data Lifeboat Service (“Service”).

You can learn more about the Service at https://datalifeboat.flickr.org. You should also review the Flickr, Inc., Privacy Policy, which applies to all data contributed by Flickr Members and collected through the use of Flickr.com (https://www.flickr.com/).

Someone has asked to use one of my photos in a Data Lifeboat. How does that work?

Wonderful! It’s up to you to decide whether you’re comfortable with this, or not. The Data Lifeboat Service provides you with the opportunity to include your Content if you wish. You’ll need to sign in with your Flickr.com credentials (so we can make sure you’re the right person), and then you can make your choice.

  • If you respond to the request, either to grant or deny consent, we will always honor your decision.
  • If you do not respond to the consent request and your image has been published to Flickr.com using All Rights Reserved, CC BY-NC, CC BY-NC-SA, or CC BY-NC-ND statements, it will not be included in the Data Lifeboat.
  • If you do not respond to the consent request and your image has been published to Flickr.com using CC BY-ND, CC BY-SA, CC BY or CC0, the CC Public Domain Mark, US Government Works, or the No Known Copyright Restrictions assertion, it will be included in the Data Lifeboat.

It’s important you know that when you consent for your Content to be included in another Flickr Member’s Data Lifeboat, the Flickr Member will download and store the Personal Data that you have consented to being included in their Data Lifeboat, as explained further below. They may also upload their Data Lifeboat, including your Content, to other platforms, or choose to store it on shared drives or servers.

Data We Collect

We collect only the data we need to give you a better experience, deliver our Service, and meet our legal obligations and responsibilities to you.

When you visit the datalifeboat.flickr.org website, we monitor and collect:

  • Your URL request, browser type and version, the type of device you are using, the operating system, the date and time of the URL request, the pages you visit on the Service, and any preferences you set while using the Service, especially regarding your participation in the Service; and
  • Any direct correspondence with the Foundation.

When you log in to the Service, whether to create a Data Lifeboat or respond to a consent request to include your Content in a Data Lifeboat, the Foundation monitors and collects:

  • Your Flickr.com NSID (i.e., the unique ID given to every Flickr Member by Flickr.com), Display Name (username), Real Name (if you have included it in your profile), email address associated with your Flickr.com account; and
  • The last time you logged in to the Service.

When you use the Service to create a Data Lifeboat, the Foundation additionally monitors and collects:

  • A Flickr.com OAuth access token that allows the Service to access data on Flickr.com on your behalf;
  • Information that you contribute during the creation of a Data Lifeboat, including:
    • The name of your Data Lifeboat and the timestamp of when you started creating it (i.e., gave it a name and added at least 1 URL);
    • The list of Flickr.com URLs to be included in it;
    • The types of URL chosen for inclusion in your Data Lifeboat (e.g., 1 album, 3 galleries, 5 user photostreams);
    • The purpose for which you are creating your Data Lifeboat;
    • The note that you write to Flickr Members when seeking consent to include their Content in your Data Lifeboat;
    • Your responses to the README form; and
    • An alternative email address for Service notification(s) (if you add one).

When you make a Data Lifeboat, you will create what we call a README. This is your timely description of why you’re making the Data Lifeboat, what you know about its contents and the purpose for which you are making your Data Lifeboat.

You are entirely in control of whether you share any Personal Data in your README. For instance, you might choose to disclose your name, credentials, or professional affiliation. When a Flickr Member receives a consent request, we provide them with your responses to the mandatory questions from your README.

The mandatory README questions are:

  1. Why are you making this particular Data Lifeboat?
  2. What’s important to you about these photos?
  3. What is the Data Lifeboat for? (i.e. one or more chosen from: personal use, educational use, commercial use, machine learning use, and archiving in the public interest)

By choosing to include Personal Data in your responses to these questions, you are providing the Foundation with your consent to our processing of this data.

As you may want to include other Flickr’s Members’ Content in your Data Lifeboat, which may contain their Personal Data or Personal Data of others, you need to disclose your intended use (the purpose) for the Data Lifeboat containing such content in your README.

When you use the Service to respond to another Flickr’s Member’s consent request to include your Content in their Data Lifeboat, the Foundation additionally monitors and collects:

  • The result of your response and the timestamp; and
  • Your preference setting for future inclusion of your Content in other Data Lifeboats.

When packaging the Data Lifeboat zipped file, the Service collects and includes the following Content in that Data Lifeboat, which is then stored by the Foundation for the 7 days the Data Lifeboat is available to download:

  • The README;
  • The image and/or video files;
  • Technical Metadata as it relates to the image and/or video files, including:
    • EXIF metadata, such as the camera type, location, date and time that the photo was taken, to the extent allowed by your privacy settings on Flickr.com;
    • The title, description and other information added to the image and/or video files, to the extent allowed by your privacy settings on Flickr.com;
  • Social Metadata, including:
    • Flickr.com NSID, Display Name (username), and Real Name (if included in the Flickr Members’ profile) of every Flickr Member who has been tagged in Content or who has contributed Content that is included in a Data Lifeboat, including comments, tags, notes and descriptions;
    • The title, description and owner of every album, gallery and group that contains a photo in the Data Lifeboat; and
    • The text of any comments and notes left on the photo.

We also receive information indirectly during the aggregation of Content provided by Flickr Members to Flickr.com. This is because the Service displays images, videos, Technical Metadata and Social Metadata contributed by Flickr Members to Flickr.com in order to facilitate the compilation of a Data Lifeboat and the consent request process, and this Content may contain Personal Data.

How We Use Data

We use your Flickr.com NSID (i.e., the unique ID given to each Flickr Member by Flickr.com), Display Name (username), and Real Name (if you have included it in your profile), email address associated with your Flickr.com account; and to enable your use of the Service, to keep it and our Service secure, for example by maintaining a public ledge of activity in the Service, and to prevent spam, malicious content, and abuse.

If you are a Data Lifeboat Creator and wish to include Content from other Flickr Members, we will use your username when posting a comment on Flickr.com on a Flickr Member’s image or video that you have selected for inclusion where that Flickr Member has enabled commenting.

We use your name and the email address you gave us for communication to send you an email notification when your Data Lifeboat is ready for download. You have 7 days to download the Data Lifeboat before it is deleted.

We may contact you for your consent to use the Data Lifeboat you have created for our marketing purposes.

If you are a Flickr Member whose photos have been selected for inclusion in a Data Lifeboat and you allow commenting, you will receive a comment on your photo(s) or video(s) on Flickr.com, sent via the Data Lifeboat Creator’s Flickr.com account. You will be given an opportunity to refuse its inclusion in the Data Lifeboat and set a preference to refuse any future inclusion of your Content in the Data Lifeboat Service. We will follow Flickr, Inc., policies when contacting you to inform you of any such requests.

How the Consent mechanism works:

  • We will not include any photo where the Flickr Member who uploaded that photo has responded and explicitly denied consent for it to be included.
  • We will not include any photo published to Flickr.com with an “All Rights Reserved”, CC BY-NC, CC BY-NC-SA, or CC BY-NC-ND license where the Flickr Member who uploaded it has not responded to the consent request.
  • We will include photos published to Flickr.com with a CC BY-ND, CC BY-SA, CC BY or CC0, the CC Public Domain Mark, US Government Works, or the No Known Copyright Restrictions assertion, even if the owner has not responded to the consent request.

We use your anonymised data for analytics and monitoring purposes, and to assess how people are engaging with the Service (e.g., how long it takes to create a Data Lifeboat on average or how many images a Data Lifeboat contains).

How We Share Data

The Foundation shares your data to maintain and improve the Service. This means we will share certain information we collect through the Service with third party providers, such as:

  • Brevo, to facilitate sending you an email notification when your Data Lifeboat is ready to download.
  • Flickr Members, via comments, including in public spaces, on Flickr.com to facilitate consent requests; and
  • Foundation staff as necessary for the operation or improvement of the Service.

We also aggregate and anonymize usage statistics to show how people are engaging with the Data Lifeboat Service. We may make these statistics public, such as for presentations on the Data Lifeboat.

We also maintain a public ledger that lists:

  • Name: The name of the Data Lifeboat (e.g., “My Swimming Club”)
  • Flickr NSID and username: (e.g., “199258389@N04” and “lomokev”)
  • Total size: the size of the Data Lifeboat zip package in bytes (e.g., 7,655,170)
  • Checksum: the checksum of the Data Lifeboat zip package (e.g., sha256:e98e9af884fc0910f8c96dc4b34b8d608f83924a14aa1d3676ae4bdb836139d8)
  • Number of photos: how many photos were included in the final zip package
  • Number of URL types: the number of different URL types that were included in the Data Lifeboat, but not the URLs themselves (e.g., “1 album, 3 galleries, 5 user photostreams”)

We will never publicly share any other of your Personal Data, unless you have chosen to make that information public. Nor will we share the Personal Data we collect or store through the Service to any third parties for monetary or non-monetary compensation.

The Foundation may be required to share information when responding to a legitimate request from law enforcement, or to prevent malicious use of the Service. In the event we are required by law to disclose information related to your Flickr Member account and your use of the Service, we will notify you at the email registered to your account unless we are prohibited from doing so.

How We Store and Secure Data

The Foundation stores data on Linode, based in London, UK. The Foundation’s server is currently located in London, where data processing also occurs.

We store and retain Personal Data only for as long as necessary to maintain, understand and improve the Service, and comply with our legal obligations.

After a Data Lifeboat is created, the Foundation stores the Data Lifeboat for a period of 7 days before it is deleted from the Foundation's Server and cloud services.

If you have agreed to share your README with the Foundation for research purposes, we will delete our copy of it after 3 months.

The Foundation has taken security measures to protect data collected through the Service, including technical and organizational measures to address online security, risk of data breaches, or loss, alteration of data or unauthorised access, and restricting access to personal data to authorized persons with a legitimate need to know for the purposes of processing, maintaining, and improving the Services.

If you email us at help@datalifeboat.org, we keep the content of your message, your email address, and your contact information to respond to your request. We use Google Groups to manage access to this email address. We delete any emails where your query has been resolved after six months have elapsed.

While you may modify or remove your Personal Data on Flickr.com any time, we cannot guarantee or warrant the Personal Data you consented to be included in a Data Lifeboat will be permanently erased by the Data Lifeboat Creator(s) in question. We will take reasonable measures to notify any Data Lifeboat Creators that we are aware have included your Personal Data in their Data Lifeboats.

Your Rights

You have the right to:

  • Access your Personal Data and be informed how your Personal Data is processed and with whom it has been shared by requesting an overview of the Personal Data we hold about you;
  • Portability, to receive the Personal Data you have provided to us in a structured, commonly used, and machine-readable format;
  • Rectification, if you believe your Personal Data has been processed inaccurately or incompletely, you may request that we modify or supplement the data; and
  • Request the deletion of your Personal Data or withdraw consent for its storage and processing at any time. A request for erasure will be processed without undue delay, within thirty (30) days at the latest. We may deny your request for erasure in case we require your Personal Data to comply with the law.

You may submit a request to access, modify or delete your Personal Data, or someone else’s if you are their authorized agent, by contacting us at help@datalifeboat.org.

Your Responsibilities

The Foundation asks that you treat the creators and subjects of the works in your Data Lifeboat with respect for the culture and sensibilities of the people whose lives, ideas and creativity are documented in the Data Lifeboat.

You are responsible for protecting the privacy rights and Personal Data of those whose content is included in your Data Lifeboat.

You have the responsibility to:

  • Specify and maintain the purpose for which you are creating a Data Lifeboat to the Flickr Members who you are asking consent from;
  • Respect the choice of Flickr Members not to have their Content included in your Data Lifeboat;
  • Respect and maintain the intellectual property rights, data protection rights, and privacy rights arising in the Content included in the Data Lifeboat you make;
  • Secure access to the Data Lifeboat by using passwords, access controls or other security measures; and
  • Remove any Personal Data of living persons included in your Data Lifeboat upon request.

Changes to Privacy Policy

The Foundation may modify or update these policies to ensure they comply with legal requirements or when the modification of our Service is required. Registered users of the Data Lifeboat Service will be notified at least thirty (30) days in advance via email about the changes. You may then decide to terminate your Data Lifeboat Service account if you object to the proposed changes. By continuing to access or use the Service following modifications or updates, you agree to be bound by the revised Privacy Policy.
